Starting July 1, 2025, Florida home and service warranty associations can use insurance instead of an unearned-premium reserve when the insurance covers 100% of claim exposure. Insurers must be authorized in Florida; home warranty insurers may instead be approved by the state as financially able. Policies cover contracts issued while they were active, even if the association did not pay the premium. Insurers must pay 100% of claims as they arise or when due if the association fails to pay, cover losses and unearned premiums, and take over claims handling if the association cannot. When a contract is canceled, the insurer refunds unearned premiums under existing cancellation-fee rules. Service warranties that cover accidental damage from handling must also be insured, except for associations exempt from reserve and insurance rules.
Starting July 1, 2025, a warranty provider's gross written premiums in force generally cannot exceed seven times its net assets. Exceptions allow a higher ratio when the provider meets financial and reporting tests. One route requires at least $2.5 million in net assets and insurance that reimburses 100% of paid claims; an insurer-based route requires at least $100 million in policyholder surplus and an A or higher A.M. Best rating. A single-license service warranty association can use a separate exemption if it or its wholly owned parent has at least $100 million in net worth and the association provides audited financial statements with quarterly certifications, or required quarterly and annual filings within 10 days after filing deadlines. Late SEC filings can lead to license suspension or revocation.
