Beginning July 1, 2025, unpaid civil or restitution penalties under Florida ethics law become overdue after 90 days. Before referring the debt for collection, the Attorney General must try to identify whether the debtor currently holds public office or employment. After receiving and verifying notice, the public employer must withhold salary-related payments until the penalty is paid. Withholding is limited to the smaller of 25% or the federal maximum, with money sent to the Ethics Commission. The public payor can retain allowed administrative costs. The Attorney General can sue to recover penalties, recover court costs and fees, or refer unpaid debt to a state-designated collection agency. Collection actions can continue for up to 20 years after a penalty is imposed; the law sets no new penalty amount.
Beginning July 1, 2025, Florida candidates, elected and appointed public officers, and public employees face new military-claim restrictions. They cannot knowingly make false claims about military service, awards, qualifications, wartime or combat service, or prisoner-of-war status for gain. Military service includes the National Guard of any state. Gain includes money, goods, public benefits, or getting or keeping public office or employment—even benefits of very small value. They also cannot wear unauthorized military uniforms, medals, or insignia for gain; theatrical professionals performing onstage are exempt. Violations carry penalties under Florida ethics law, and prosecution under other laws remains possible.
