Button family receives payments and fee protections

Effective upon becoming law, the act requires the Pasco County School Board to make $1.2 million in one-time payments. It directs $1 million from uncommitted funds into a trust solely for Marcus Button, covering losses caused by an employee’s negligence. Another $200,000 goes to Robin Button, his surviving parent and natural guardian, for losses connected to his injuries. The law expresses its intent that government liens from Marcus’s care, including Medicaid liens, be waived and paid by Florida. Total lawyer fees for the claim cannot exceed 25% of the awards, or $300,000.

Button family faces limits on crash claims

The law makes the school board’s payment under Florida’s 2009 liability law, plus these awards, the sole compensation for covered claims. This covers all past, present, and future claims arising from the September 22, 2006 crash and the facts described.
