Beginning October 1, 2025, landlords must give tenants a separate “FLOOD DISCLOSURE” before or when signing a rental agreement lasting at least one year. It covers known flooding, flood insurance claims including NFIP claims, and flood aid including FEMA assistance. The form defines flooding and warns that standard renters’ insurance generally does not cover flood damage. If a landlord fails to disclose and flooding damages a tenant’s belongings by at least 50% of their market value on the flood date, the tenant can end the lease by giving written notice and surrendering the home within 30 days. The landlord must refund prepaid amounts for later periods, but the tenant still owes amounts due before termination.
Beginning October 1, 2025, mobile home park owners must give lessees a separate “FLOOD DISCLOSURE” before signing or at occupancy, whichever comes first. It covers known flooding, flood insurance claims including NFIP claims, and flood aid including FEMA assistance. The form defines flooding and warns that standard homeowners’ and renters’ insurance generally does not cover flood damage. If the owner fails to disclose and flood damage to the home and belongings costs at least 50% of their market value on the flood date, the lessee can give written notice to end the agreement within 30 days. The owner must refund prepaid amounts for periods after termination; the lessee remains liable for amounts owed before termination.
Beginning October 1, 2025, home sellers and condominium or cooperative developers must give buyers a separate form titled “FLOOD DISCLOSURE” at or before signing. It reports known flooding during ownership, flood insurance claims including NFIP claims, and flood aid including FEMA assistance. The form defines flooding to include overflow, rapid runoff from established water sources, and standing water that lasts after rain. It warns that standard homeowners’ insurance generally does not cover flood damage and advises buyers to ask about separate coverage.
