Summary
Prohibits the Land Use Commission from imposing exactions from a residential development for educational purposes. Repeals school impact fees. Abolishes school impact fee subaccounts within the School Facilities Special Fund and transfers unencumbered balances to the School Facilities Special Fund. Abolishes fair share contribution and impact fee accounts within the DOE Donations – Facilities Trust and transfers unencumbered balances to the School Facilities Special Fund. Provides that any existing educational contribution agreements executed with the Department of Education or School Facilities Authority before the repeal of school impact fees shall remain in effect. Transfers existing educational contribution agreements from the Department of Education to the School Facilities Authority. Repeals a requirement for the School Facilities Authority to report to the Legislature. Appropriates funds from the School Facilities Special Fund. Effective 7/1/3000. (SD1)

School fees for some affordable homes
For certain affordable housing projects, only homes reserved for households that meet the applicable income rules qualify for school impact fee exemptions. This applies to projects processed under specified state housing laws and to housing meeting state affordable-housing definitions. Other homes in those projects may owe fees, which can raise project costs. The law does not say whether those costs will raise rents or home prices.
Deadlines and rules for school land
For required school land, the state must accept the title within five years after subdivision work and needed offsite infrastructure are complete. If it does not, the dedication requirement is met and the land returns to the developer. After accepting the land, the state must begin school construction within seven years or the land returns to the developer. Existing educational contribution agreements and related documents tied to certain approval conditions or Land Use Commission decisions remain in force unless the parties mutually end or renegotiate them.
School fee breaks for some housing
The law exempts several types of development from school impact fees, including nonresidential and government projects, single-room housing, and certain Hawaiian Homes and community-development housing. Exemptions also cover housing that bars school-age children, pays the transient lodging tax, or has an existing school contribution agreement. Projects with fewer than 500 homes qualify, but related phases count together and developers cannot split projects to avoid fees. Some income-restricted homes and units for residents earning up to 140% of county median income qualify, as do studios or homes without a separate bedroom under 400 square feet. These amended rules apply to new residential developments permitted or approved by June 30, 2029, and the law prevents them from ending on July 1, 2029.

SB 2338, RELATING TO HOUSING.
Exempts certain positions under the Hawaii Housing Finance and Development Corporation (HHFDC) from the requirement that the employment actions and job descriptions of HHFDC officers and employees be subject to approval by the Director of Business, Economic Development, and Tourism. Increases the salary cap for the Executive Director of HHFDC. Renames the position of Executive Assistant to Deputy Executive Director for HHFDC and increases the salary cap for the Deputy Executive Director. Establishes the Finance Manager position within HHFDC. Establishes a cap on the term of employment contracts for HHFDC and the Hawaii Public Housing Authority. Effective 7/1/3000. (HD2)
HB 2021, RELATING TO TRANSPORTATION.
Establishes safe riding behaviors for electric bicycles. Prohibits the operation of high-speed electric devices in certain locations. Requires all public schools in the State to prohibit high-speed electric devices on public school campuses. Prohibits electric bicycles on elementary and middle or intermediate school campuses. Authorizes public high schools to require county registration and decals for any electric bicycle brought onto its premises and deny entry or require parent retrieval for an unregistered electric bicycle. Establishes labeling and signage requirements for electric bicycles. Prohibits the operation of a moped or electric motorcycle in certain locations. Amends the definition of "bicycle" for purposes of county vehicular taxes. Defines "electric bicycle" in place of "low-speed electric bicycle". Authorizes the seizure of non-road-legal, nonconforming electric bicycles and high-speed electric devices. Defines "electric micro-mobility device" and requires the same regulations as electric foot scooters. Prohibits a person under the age of sixteen from operating a class 2 or class 3 electric bicycle without direct supervision. Authorizes a person to ride an electric bicycle on a sidewalk under certain circumstances. Prohibits a person from operating a bicycle or electric foot scooter under the age of eighteen without a helmet. Repeals the requirement that moped drivers use bicycle lanes. Substitutes the term "motor scooter" with the term "motor-driven cycle". Effective 3/22/2075. (SD2)
HB 2023, RELATING TO TRANSPORTATION.
Requires the Department of Transportation to administer a statewide program for certification of active intelligent speed assistance systems and select a vendor for the installation and maintenance of systems. Limits the civil liability of motor vehicle manufacturers, distributors, and retailers for active intelligent speed assistance systems. Makes circumventing or tampering with an active intelligent speed assistance system a misdemeanor. Allows the Judiciary to impose the installation of active intelligent speed assistance systems as an additional penalty and as part of a license suspension or revocation for repeat offenders of certain traffic violations. Effective 7/1/3000. (SD1)
SB 2964, RELATING TO PROPERTY INSURANCE.
Requires homeowners insurance producers to notify policyholders that they may submit information regarding improvements made to the insured residential property, which shall then be submitted to the homeowners insurer. Requires homeowners insurers to reevaluate the replacement cost estimate based on the information submitted by a policyholder, and offer the policyholder the option to purchase additional coverage to cover the full amount of the replacement cost estimate. Establishes an administrative penalty. Effective 7/1/3000. (HD1)

Establishes within the Department of Health a one-year KupunAloha pilot program to provide in-home health care and support services to eligible participants who do not otherwise qualify for government assistance for these services. Authorizes the Department of Education to award a high school diploma to qualified persons who did not receive a high school diploma as a result of compulsory or voluntary induction into the armed services of the United States or whose high school education was interrupted due to wartime practices during World War II, the Korean War, or the Vietnam War.
