People alleging abuse can refuse mediation

In contested parentage and divorce cases, courts cannot make a person alleging domestic abuse take part in mediation against their wishes. Mediation can proceed only with the alleged victim’s approval and safety protections, including a mediator trained in domestic abuse. Mediators must screen for abuse and cannot mediate when abuse appears or is alleged unless those protections are in place. In divorce custody or visitation cases, the victim can bring a chosen support person; the other party gets the same option if the victim uses it. A party may also bring an attorney or other designated person and withdraw a waiver made before mediation.
