Protects HSA high-deductible plans

If you are in an HSA-qualified high-deductible plan, Kentucky cannot use a state cost-sharing rule that makes your plan lose HSA status. The state may apply that cost-sharing only after you meet the federal HDHP minimum deductible. This rule controls over any conflicting state law.

Applies to new or renewed plans

Sections 1 and 2 apply to insurance policies, certificates, plans, and contracts issued or renewed on or after the law’s effective date. Existing policies that are not renewed stay the same until renewal.

Protects HSA plans for state workers

If you are a Kentucky state employee in an HSA-qualified plan, Chapter 18A cost-sharing must follow this protection. The state can only apply its cost-sharing after you meet the federal HDHP minimum deductible. This applies even if Chapter 18A says otherwise.
