Assaulting many on-duty public servants is a Class D felony. Covered groups include peace officers; jail and juvenile facility staff; healthcare workers on hospital, clinic, or long-term care premises; social workers; EMS; firefighters; rescue squad members; probation and parole officers; inmate transport officers; and school employees and volunteers. During a declared disaster emergency in the impacted area, the offense becomes a Class C felony. A person confined in a jail or certain state facilities who injures staff or throws bodily fluids at them commits a Class D felony. Making a peace officer contact saliva, vomit, mucus, blood, semen, urine, or feces is a Class B misdemeanor, or a Class A misdemeanor if the adult knows they have a serious communicable disease and evidence shows that contact likely spreads it.
Public agencies can set up peer support counseling for public safety employees. Covered jobs include police, jailers and correctional officers, firefighters, certified 911 telecommunicators, and licensed EMS. Peer support specialists are trained public safety employees. Peer support talks are confidential and legally privileged in cases. Disclosure is allowed for suicide plans, imminent serious harm, required abuse reports, admissions of crimes, or when law requires it. Agencies may use anonymous data for research, and observations learned outside a session are not covered.
