Local permits and pedestrian safety standards

Cities and counties can pass ordinances to allow limited exceptions to the statewide ban. They must use a clear, uniform, and objective process to request and approve permits. Permissions must be narrow and time‑limited, and officials must keep records with reasons. These local rules must follow any Transportation Cabinet regulations. The Transportation Cabinet can set minimum pedestrian safety standards for state‑maintained road areas.

No standing or sitting on state roads

The law bans sitting, kneeling, reclining, standing, or staying still in state‑maintained road areas not made for pedestrians. This includes lanes, shoulders, medians, ramps, and nearby grassy or drainage areas. You are allowed if you have a medical emergency, or a vehicle emergency and stay near your vehicle. Emergency responders and utility workers on duty are allowed. Sidewalks, marked crosswalks, and transit stops are allowed. This rule is added to the state pedestrian law, so standard enforcement and penalties under that law apply.
