New limits for workers' comp self-insured groups

Beginning July 15, 2027, the Commissioner does not approve any new workers' compensation self-insured groups. Groups authorized before July 15, 2027 can keep operating. Authorized heterogeneous groups can make contracts and can sue or be sued in the group's name. The Commissioner must issue rules to oversee these groups and keep related records starting July 15, 2027.

Process to dissolve solvent insurers

The law lets a solvent insurer not in delinquency dissolve under a written plan. The plan must transfer or lawfully end all policies, fully cover all obligations, and name trustees. The board and at least two-thirds of voting policyholders or members must approve at a special meeting with notice the Commissioner approves. Trustees certify that liabilities are handled and assets distributed; the Commissioner examines the company and must approve the articles unless they are unlawful, unfair, inequitable, or prejudicial. The company then files the approved articles with the Secretary of State, and the corporation ends on that effective date.
