Penalties rise based on the age shown. If you know the image shows someone under 18, it is a Class D felony. If you know it shows someone under 12, it is a Class C felony, which is more serious. Anyone convicted under this law cannot get probation or parole until serving at least 85% of the sentence.

Crime to possess or view child sex images

The law makes it a crime to knowingly possess or control sexual images that show a minor, including computer-made images you know show a minor. It is also a crime to intentionally view such material. Only on‑purpose, voluntary viewing counts; accidental viewing does not. Viewing in a police investigation or court case, or by a minor, the minor’s parent or guardian, or school officials investigating, is not charged. These exceptions apply to viewing only; possession remains illegal.
