Automatic protection orders after assault convictions

A conviction for first- or second-degree assault, or a felony attempt, conspiracy, facilitation, or solicitation of those crimes, counts as an application for a protective order when the victim and defendant are family, an unmarried couple, or in a dating relationship. The victim can ask the court not to apply this automatic request. The same court may issue the order, and the conviction is enough proof without extra hearings. Orders can last up to 10 years and can be renewed in 10‑year steps. This increases safety for victims and adds lasting legal limits on convicted offenders.

Statewide domestic violence data and reports

The state center collects domestic and dating violence data and issues a yearly report by July 1. The report goes to KCADV (ZeroV), the Governor, CHFS, two legislative committees, the LRC, the courts, and the Attorney General. ZeroV may send best‑practice and policy recommendations by November 15. Kentucky State Police must share JC‑3 incident fields, arrest counts and charges, plus LINK data on protection orders served and average service time. The courts must share counts of petitions, emergency and temporary orders, grants and denials, lawyer status, party relationships and demographics, pregnancy status if noted, and charges for violations. CHFS must share child dependency/abuse numbers tied to family violence and shelter stats, including who was served and what services they received. The Justice and Public Safety Cabinet must provide a uniform electronic JC‑3 form to all law enforcement and write rules to ensure agencies submit the required data.
