Beginning July 1, 2026, the Transportation Cabinet cannot ban recycled asphalt products on a project if the mix meets its performance standards. By October 31, 2026, and each year after, the Cabinet reports miles using each material, cost per mile, and compares durability and pavement quality. These rules guide material choices and track performance across state projects.
Beginning July 1, 2026, the state runs a pilot through June 30, 2030 to test chip seal and recycled asphalt on gravel roads. Counties can use their existing county road aid funds to surface existing gravel roads with these materials. Each year, a county’s spending on these treatments is capped at the share of its road miles that are gravel on July 1. By October 31, 2027, and each year through October 31, 2030, the state reports by county: miles treated, cost per mile, and ratings of durability and pavement quality.
