Acting and deputy treasurers ensure continuity

If a treasurer cannot serve for more than 5 days due to illness, incapacity, absence, or other cause, or if the office is vacant, the fiscal court may appoint an acting treasurer. An acting appointment lasts until the treasurer returns; for a vacancy it lasts up to 60 days or until the term ends, whichever comes first. The court must appoint a treasurer for the rest of the term when the acting period ends, or sooner. If the court doubts the treasurer can return, it must consult a licensed doctor acceptable to both sides; if cleared, the treasurer is reinstated within 10 days. When reinstated, the acting treasurer must stop, turn over records to the county judge/executive, and settle accounts with the fiscal court within 30 days. The fiscal court may also appoint a deputy treasurer, who serves under the treasurer, can perform the office’s duties, must take the oath and post a bond, and may serve as acting treasurer; the county may pay the deputy’s bond premium.

Regular four-year county treasurer appointments

Each county’s fiscal court must appoint a county treasurer by June 30 every four years. The 4-year term starts July 1 after the election set by the Kentucky Constitution. If no one is chosen at the regular June meeting, the county judge/executive must call another meeting before June ends and record the date in the court’s order book.

Who can serve as county treasurer

To be appointed treasurer, a person must be a Kentucky citizen and be at least 25 or have a bachelor’s degree from a regionally accredited school. The treasurer must take the constitutional oath before the fiscal court and post a bond with an approved surety; the fiscal court may pay the bond premium from county funds. The fiscal court may remove a treasurer or acting treasurer at any time for neglect of duty, incompetency, or dishonesty.
