The law bars governments from treating religious groups worse than other essential businesses during an emergency. Neutral health, safety, and occupancy rules can still apply. Religious organizations can sue or defend claims without first going to an agency. Courts can order relief, award damages and attorneys’ fees against the government, and claims must be filed within two years.
The law defines what counts as an executive action during a COVID-19 emergency. It includes official orders and agency guidelines from state, federal, or local authorities, including industry-specific rules adopted by a state agency. It excludes informal statements and does not create a duty of care.
The law defines an animal health emergency and lets the Agriculture Commissioner declare one after consulting the state veterinarian. During an emergency, the Commissioner can quarantine animals and equipment and set roadblocks to stop movement. The Commissioner can quickly hire licensed veterinarians and buy needed supplies without normal bidding. The Commissioner can ask to waive transport limits for animal feed and medicine and can request local, state, or federal help. These steps protect animal and public health, but they can limit owners’ movement and use of animals and gear during a crisis.
