Government faces limits on ballot advocacy
The law bans using local, state, or federal tax money and public resources to support or oppose ballot questions. This includes government equipment, buildings, websites, email, social media, and employee work time, including school staff. Violators face a $500 fine for a first offense and $1,000 for a second. Each later offense brings a Class A misdemeanor and a $1,000 fine. Public employees may advocate on personal time using nongovernment resources unless another law bars it. Educational television has an exception when it gives both sides equal opportunity. Certain associations may advocate on ballot questions directly affecting their members, but cannot use public money or resources.
