Ten new wine and beer licenses in Lexington

The town of Lexington can issue 10 new on-premises wine and malt licenses. One license each is reserved for Pinot's Palette, Galaray House Art Gallery, Lexington Venue Theater, and Fable Brewing. Six licenses are limited to businesses inside the Village, Multifamily, or Village High-Rise overlay districts on the map dated March 24, 2023. All 10 licenses must be issued within three years after the act’s effective date.

Named license transfer and renewal rules

The four named licenses cannot be moved to another address. The licensing authority may give the license to a new applicant at the same address. The applicant must provide letters from the Department of Revenue and the Department of Unemployment Assistance showing good standing and full payment. If the license is not renewed, cancelled, revoked, or not in use, it must be returned. The authority may reissue it within three years; after that, it dissolves.

Zoned license transfer and reissue rules

The six zoned licenses cannot be moved outside the original overlay zone. The licensing authority may reissue one only to a business inside that zone. The applicant must provide letters from the Department of Revenue and the Department of Unemployment Assistance showing good standing and full payment. If a license is not renewed, cancelled, revoked, or not in use, it must be returned. The authority may reissue it under the act’s conditions; there is no three-year deadline to reissue.

Use rules for Lexington alcohol licenses

Licenses issued under this act follow chapter 138 rules, except section 17 does not apply. You may use the license only in the dining room of a common victualler. The licensing authority can allow other public rooms if it certifies this in writing. If you hold a zoned license, the face of the license must show the overlay district name.
