Upton land swap with conservation safeguards

The law lets the state convey two state-owned parcels off Maple Avenue in Upton to Upton Development Group, Ltd., even though normal state land-disposal rules would otherwise apply. The parcels match a plan dated October 7, 2013, and deeds on file in Worcester County (book 2651, page 81 and book 2646, page 147). The state commissioner, in consultation with the Department of Conservation and Recreation, sets the final borders. In return, the developer must give the state parcels 1B and 3B for conservation, to be managed by the Department of Conservation and Recreation. If parcel 1B or 3B is unacceptable due to environmental contamination, the developer must provide replacement land with equal or greater acreage and natural resource value that the state accepts for conservation.
