Clear command for Maryland military on duty

The law covers all units of the Maryland Military Department, including the National Guard and the Maryland Defense Force. When members are on State active duty, they report to the Adjutant General or a designated Guard officer, even if that leader is in federal status. The Governor can order State active duty during crises, martial law, to enforce the laws, or for militia functions. While enforcing the laws, members on State active duty have the same authority as police, statewide, for the length of their duty. During State active duty, ranking officers must work with local police or, if the Governor orders and the situation requires, may direct them and assume their powers. Beginning July 1, 2026, these supervision and command rules apply.

Emergency act takes effect on approval

The Act is an emergency law and takes effect upon enactment after a three‑fifths vote in each House. The Governor approved it on April 14, 2026. However, most supervision and command rules begin on July 1, 2026.
