Beginning October 1, 2026, the law treats hypertension as work-related for certain paid public-safety workers. It presumes disability for workers’ compensation if you are a paid firefighter, firefighting instructor, rescue squad member, advanced life support unit member, or sworn State Fire Marshal member. You must have a diagnosis by an authorized provider, be prescribed hypertension medicine for at least 90 straight days, have at least 2 years of service in Maryland, and be currently employed. Your employer must be an airport authority, county, fire control district, municipality, or the State. The presumption is rebuttable by the employer or insurer.
Beginning October 1, 2026, if you qualify for workers’ compensation under the hypertension presumption, you are not eligible for disability retirement on that same condition. This does not apply if your collective bargaining agreement clearly allows both.
Beginning October 1, 2026, you can file a separate heart or lung disease claim even if you also file a hypertension presumption claim. If you seek benefits for heart or lung disease under the general rule, you must file a separate claim for those conditions. You cannot receive duplicate benefits for the same condition when you file under both tracks.
