New right to sue for rights violations

Beginning 2026-05-12, you can sue certain officers who, under color of law, take away your rights. The Maryland Attorney General can also bring these cases. Courts can award money damages or order actions to stop. If you win, the court may make the officer pay your reasonable lawyer and expert fees.

Limits on suits, immunities and deadline

Beginning 2026-05-12, defendants can use any immunity defense that existed when your claim arose. You must file within five years after the claim accrues. If you file late, the court can dismiss your case.

Who you can sue and which rights

Beginning 2026-05-12, the law explains who you can sue and which rights are covered. A covered officer can arrest for U.S. law and carry a firearm, but not local officers on U.S.-focused task forces. Protected rights include the U.S. Constitution, the Maryland Declaration of Rights, the Maryland Constitution, and federal and state laws. Judicial officer misconduct means causing or allowing you to lose a protected right. The law also keeps other Maryland rules that let you sue local governments.
