HOAs and condos cannot block EV chargers

Beginning October 1, 2026, condo and HOA documents cannot ban or unreasonably limit EV chargers in shared or limited‑common parking. Boards may install or allow chargers in those areas. The law also applies to rules recorded before that date, so old recorded bans no longer apply.

Licenses to use common areas for chargers

Beginning October 1, 2026, condo and HOA boards can grant licenses to use common elements needed to install or power EV chargers. A license can last up to 3 years and can be renewed.

Boards must protect parking when adding chargers

Beginning October 1, 2026, boards must consider whether the community has enough parking before placing chargers in shared or limited‑common spaces. This check can limit or delay some charger locations to protect parking needs.

Charger projects go through association budgets

Beginning October 1, 2026, charger projects by condo and HOA boards must follow the normal common‑area budget process. Costs are handled like other renovations of similar size. This applies when the board installs or authorizes chargers.
