Two-person crews on shared-corridor freight trains

Freight trains that share a corridor with high-speed passenger or commuter trains must have at least two crew members. Hostler service and yard utility employees are excluded. This is a safety rule for shared corridors. The railroad company is responsible for any violation by its agents or employees. The Commissioner can fine up to $10,000 for a willful violation, and up to $25,000 for a repeat willful violation within three years. This rule takes effect only after New York, Pennsylvania, and Virginia pass similar laws and Maryland receives notice.

When the two-crew rule starts

Section 1 (the two-crew rule and penalties) takes effect only after New York, Pennsylvania, and Virginia enact similar laws. Maryland’s Department of Labor must notify the Department of Legislative Services within 10 days after that occurs. If DLS gets the notice on or before October 1, 2056, Section 1 starts on the notice date. If DLS does not get the notice by October 1, 2056, Section 1 is null and void. Subject to that, the rest of the Act takes effect October 1, 2026.
