New rules for noncitizen personal representatives

Beginning October 1, 2026, some noncitizens can serve as a personal representative. To qualify, you must be a lawful permanent resident, make your home in the United States, and be the decedent’s spouse, ancestor, descendant, or sibling. Noncitizens who do not meet all of these rules cannot get letters. Registers of wills and courts apply these rules when deciding who has priority.
