Maryland redirects donated medicines to eligible patients

Beginning July 1, 2026, Maryland creates a medicine donation pilot at four Maryland drop-off sites registered for National Prescription Drug Take Back Day. The Secretary of Health runs the pilot with the federal Drug Enforcement Administration (DEA). Sites must separate eligible, unopened prescription medicines that are not controlled substances, package them under state rules, and transfer them to a repository. Controlled substances must go to the DEA. The Board of Pharmacy oversees the repository program, which accepts donated prescription medicines, over-the-counter medicines, and medical supplies for eligible patients. It also accepts items returned to pharmacies for proper disposal. Drop-off sites can be pharmacies, health care facilities, or other designated entities in Maryland or another state. They must participate voluntarily and have no final disciplinary order from a health occupations board. Repositories must be licensed pharmacies that participate voluntarily and have Board approval to accept, dispense, or dispose of donated items. They can be in any state, but Maryland repositories must have no final disciplinary order. By October 1, 2027, the Secretary must report to the Board and General Assembly on eligible medicine counts at each pilot site, medicine types, and counts failing state packaging rules. The law expires June 30, 2028, unless the General Assembly extends it.
