Beginning October 1, 2026, the Department may set up one or more affiliated foundations. They can take donations from businesses, governments, nonprofits, and people, and the Department deposits the money in a separate special fund. Foundations can partner to expand assistive technology access, workplace training and accommodations, and integrated, affordable, accessible housing. These actions support Department programs and can increase access, but they do not create a new entitlement.
Beginning October 1, 2026, the Maryland Department of Disabilities runs affordable and accessible housing programs. The goal is more integrated, affordable, accessible homes in communities of choice. The law does not list specific payments or exact eligibility rules.
Beginning October 1, 2026, foundations are separate from the State, cannot set policy or eligibility, and their debts are not State debts. Each foundation must get an independent CPA audit every year; without a recent audit, it cannot solicit or receive funds, and the Department cannot accept its money. The Department must submit each foundation’s operating policies to the Attorney General and the State Ethics Commission for review. Department staff may serve on a foundation board without pay; approved expense reimbursement is allowed, and the Department must notify the Ethics Commission, which has 30 days to raise concerns. By September 1 each year, the Department reports who served and how the policies were carried out.
