New licensing for vape and e-cig firms

The law creates a separate license system for electronic smoking devices. Beginning October 1, 2026, anyone who makes, distributes, or sells these products must hold a Title 16.7 license, even if they already have a cigarette or other tobacco license. It defines manufacturers, retailers, wholesalers, importers, and vape shop vendors and uses a 70% sourcing rule for wholesalers and importers. It covers e-cigs, vape pens, hookahs, and vaping liquid, but not FDA-approved therapies or separate batteries. This ends cross-licensing across product lines.

Vape license fees and a grace period

Beginning October 1, 2026, applicants must get any needed county license and apply to the Executive Director. The fee is $25 per electronic smoking devices license. Wholesaler distributors and wholesaler importers pay $150. Retailers and vape shops that already hold a §16–205(b) or §16.5–204(b) license do not pay another fee. A person holding a Title 16 or 16.5 license on September 30, 2026 can keep operating without a Title 16.7 license until that license expires.
