Care homes must disclose insurance gaps

Beginning October 1, 2026, nursing homes and assisted living programs must tell you in writing (paper or electronic) if they have no professional liability (malpractice) insurance or if coverage lapsed and was not renewed. Prospective residents get notice at the first visit during any no‑coverage period, and at application if there is no coverage then. Current residents get notice within 30 days after a lapse. You must sign the notice, and the facility must keep it in its records. Nursing homes, and facility‑based assisted living programs, without this coverage must post a clear on‑site notice.

Midwives must disclose malpractice insurance status

Beginning October 1, 2026, nurse midwives and licensed certified midwives must tell patients in writing (paper or electronic) if they have no professional liability (malpractice) insurance or if coverage lapsed and was not renewed. Patients get notice at the first visit during any no‑coverage period, except for incidental free care. The notice must also be part of each informed consent before any procedure. You must sign the notice, and the midwife must keep it in your medical record. Practices without coverage must post a clear on‑site notice.
