The Department of the Environment can approve construction on new animal feeding operations when the general discharge permit is administratively extended. Farm operators can start building after Department approval. They must show they meet the extended permit’s coverage and all other laws, rules, and required construction permits. For other facilities, the rule still requires a discharge permit before construction.
The law is an emergency measure and takes effect the day it is enacted. It passed with a three-fifths vote in each House. Its rules apply right away.
