Anne Arundel off-sale license cap and exceptions

The law caps Class A and Class D off-sale licenses at one for every 3,500 people in each district. The cap does not apply to transfers or renewals of licenses issued on or before July 1, 2025; to locations in the 6th tax assessment district; to on-site consumption permits for Class 5 brewery license holders; or to applications filed on or after Jan 1, 2023 that the Board approved before July 1, 2025. The Board cannot approve moving a Class A or D license outside the district where it was on July 1, 2025, or outside the district where a newer license was first issued. The Board may issue Class A, B, or D licenses when needed to serve the public, but these Class A and D rules still apply.

Where Anne Arundel license rules apply

These licensing rules apply only in Anne Arundel County. An “assessment district” is a county tax district shown on the Council’s “Tax Assessment Districts, 2005” map. District population comes from the latest federal census or county estimates from the Office of Planning and Zoning. The law takes effect July 1, 2026 and ends if a separate 2025 termination rule (Chapters 818 and 819) takes effect.
