Beginning October 1, 2026, the law defines mobile and semipermanent food service facilities. In Washington County, these mobile and semipermanent facilities are exempt from the rule to provide public toilets and sinks. The exemption applies to the public restroom requirement tied to customer seating. Staff toilet and handwashing rules still apply.
Beginning October 1, 2026, the law defines on-farm food service. You can operate up to 30 straight days, with up to two renewals each year. The Department decides which foods may be served. Agritourism sites, Class 4 wineries, and Class 8 farm breweries may use a portable chemical toilet. It must meet the lavatory rules and sit at least 25 feet from any well.
