15-day notice after federal hospital warning

If the Centers for Medicare and Medicaid Services issues a warning tied to a triggering event under Maryland’s all-payer model, the commission must notify leaders. It must write to the Governor, the Secretary, and the General Assembly within 15 days. This rule starts June 1, 2026.

Hospitals must adopt and post immigration enforcement policy

Each hospital adopts a written policy for immigration enforcement events. Do this by January 1, 2027, or within three months after the state model is posted, whichever comes first. The policy must follow guidance from the Attorney General. Hospitals must post the policy on their website, share it with all staff, and train all staff every year. Hospitals run by a state or local unit that already must follow the Attorney General’s guidance are exempt.

State guide for hospital immigration enforcement

The state health commission develops a model policy for hospital responses to immigration enforcement. It consults the Attorney General and the Maryland Hospital Association. The policy protects patient privacy and the safety of patients, guests, and staff. The commission posts the model on its website by October 1, 2026. The law takes effect June 1, 2026.
