Free first visits and fair mental health copays
Beginning January 1, 2023, group health plans with an effective date on or after that date cover your first primary care visit each plan year with no copay, coinsurance, or deductible. They also cover your first behavioral health visit each year at no cost. Behavioral health means care for mental health or substance use conditions. After that first behavioral visit, your copay for behavioral health cannot be higher than your primary care copay. These rules do not apply to small-group plans subject to subsection 3‑A. They also do not apply to HSA‑compatible high‑deductible plans unless the IRS allows it, or to plans with no deductible, no coinsurance, and federally compliant out‑of‑pocket limits.
