Tougher penalties and faster wage payments

When a wage case is final, payment is due within 30 calendar days. Late payment can trigger up to $1,000 for each day it remains unpaid. If the Director orders a fix, failing to correct after the allowed period can also cost up to $1,000 per day. A good‑faith appeal can delay the correction clock until appeals end. Employers ordered to pay wages, liquidated damages, or interest must certify payment within 7 calendar days after appeals end and show it was sent to the worker’s last known address or attest under penalty of perjury. If money is still unpaid, the Director can levy bank accounts and other non‑exempt property by notifying third parties; obeying the levy protects the third party, and ignoring it can create liability.

Stronger investigations into wage violations

The Bureau of Labor Standards can investigate suspected wage and hour violations. The Director can review books and records, require oaths, and take testimony in the county where the person lives or does business, or in Kennebec County for nonresidents. Investigative subpoenas follow Title 5, section 9060, and can be served by hand, at a Maine business location, or by registered or certified mail to a principal office or listed service address. These tools help workers get remedies and require employers and third parties to respond.

Employers must share violation notices

Employers must post any notice of violation where employees can see it, or deliver it to each worker if no posting spot exists. If a notice covers a set time period, the employer must send it to every employee who worked then. Mail, email, or text is fine, in the language the employer normally uses with those workers.
