Refund with interest for Social Security offsets
If your Maine PERS disability pension was cut because you received Social Security disability, you get a refund. The refund covers cuts starting January 1, 2024 and includes any cost-of-living increases. You must have been receiving a Maine PERS disability pension on December 31, 2024. Interest at 6.5% accrues on the refund from January 1, 2024 until the payment date.
Maine public worker disability pension reduced by other benefits
The law reduces Maine PERS disability pension checks by other disability payments you get. Workers’ compensation is subtracted, except amounts listed in former Title 39, section 56-B or Title 39-A, section 212(3). Your Social Security disability is also subtracted if your job was covered by Social Security when you became disabled. This lowers your monthly pension payment. The law also removes two related subsections from the pension statute.
