Easier rebuilding rules for storm-damaged fishing businesses
Effective upon approval, Maine law removes one hurdle for businesses seeking exceptions to local shoreland zoning or floodplain rules. Applicants no longer need to prove their land cannot earn a reasonable return without the exception. They must show the local appeals board substantial damage from storms or flooding during January 9–13, 2024. Eligible property includes docks, piers, wharves, and structures on them. The work must rebuild or replace the property in kind, and the structure or its use must need a waterfront location. The board must find the application complete for processing by December 31, 2027. Other variance standards still apply, and approval is not guaranteed.
