Easier rebuilding for storm-damaged fishing docks
If your dock, pier, wharf, or a structure on it was badly damaged by the January 9–13, 2024 storms, local approvals are easier. The law removes the “reasonable return” variance test for shoreland or floodplain variances decided by a municipal board of appeals. You must rebuild the same kind of structure, and it must be functionally water-dependent. Your variance petition must be deemed complete by the board by December 31, 2027.
