More flexible approvals for housing projects

Maine towns can adopt less restrictive approval rules for housing structures and accessory dwelling units, such as backyard apartments. This option applies only when the town has authority to grant a zoning exception under state law. That includes the new exception for damaged waterfront facilities. Towns do not have to adopt easier rules, so approval is not guaranteed.

Easier rebuilding permits for fishing facilities

Maine town appeals boards can grant zoning exceptions to help rebuild substantially damaged docks, piers, wharfs, and related structures. Exceptions cover bans on construction beyond the mean high-tide line and flood-height requirements for structures on docks, piers, or wharfs. Applicants must show substantial damage under local floodplain rules and a use that depends on waterfront access under federal rules. Rebuilt facilities must be protected from flood damage as far as practical, with only the smallest exception needed. Applicants do not need to prove that the property cannot earn a reasonable return without the exception. Other hardship safeguards remain: unique property conditions, no change to the area's essential character, and no owner-caused hardship. Towns can keep additional limits, and approval is not guaranteed.
