Noncompete ban protects some health care workers

Maine law bars noncompetes for health care employees who have no ownership stake in their employer. This covers people qualified or licensed under state law to provide health care services in Maine. A noncompete limits where someone can work. The ban applies to agreements entered into or renewed on or after the law's effective date.

Noncompetes must respect patients' provider choice

An enforceable noncompete between an employer and a health care practitioner must recognize patients' right to choose their own practitioner. This protects patient choice even when the agreement can be enforced. The requirement applies to agreements entered into or renewed on or after the law's effective date.

Health care workers lose noncompete waiting period

Maine's general noncompete waiting period no longer applies to agreements between employers and health care practitioners. That period is one year of employment or six months after signing, whichever is later. Removing this delay does not make an agreement enforceable or set a new start date. This change applies to agreements entered into or renewed on or after the law's effective date.
