Bill Overview
Analyzed Economic Effects
4 provisions identified: 1 benefits, 1 costs, 2 mixed.
Temporary privacy for certain vehicle records
Maine's Secretary of State can temporarily keep records of a nongovernment vehicle confidential. A criminal justice official must request this in writing and show that privacy serves public safety. The protection lasts for a set period, no longer than the vehicle's current registration.
Limited DNA records for charged people
People identified and charged through a search of Maine's DNA database have limited access to DNA records. They may receive their own records and other records allowed under Maine criminal court rules. Authorized criminal justice agencies, law enforcement agencies, and forensic labs may receive DNA records. The FBI may receive records for its national DNA database, and medical examiners and coroners for identifying remains.
Accident data privacy, access, and copy costs
Personal details in accident databases maintained, managed, or contributed to by Maine State Police are confidential, with legal exceptions. Plate-number recipients must sign an affidavit agreeing not to identify or contact anyone using the number, or share it. Data that do not identify people are available to the public. Copies may cost money, and the usual public-records copy-cost limits do not apply.
Doctors must provide contacts, gain privacy
Maine medical board applicants and licensees must provide a current professional address and phone number for public contact. They must also provide a home address, personal phone number, and email; these and application health details are confidential. A home address and phone number are public when supplied as public contact details. Confidential information may go to government licensing or disciplinary authorities, or health care providers deciding a physician's employment or privileges. The board must remove confidential information before allowing anyone to inspect or copy applicant or licensee records.
