PFAS and well testing rules for rentals

Beginning January 1, 2022, landlords must test each private well every 5 years for arsenic and other items in the state’s uniform list. Tests must use a lab certified by the state. Landlords must give tenants the results within 10 days and tell new tenants within 10 days. By January 1, 2027, landlords must also test for PFAS using the latest EPA‑approved methods that report the highest level found. Landlords arrange and pay for these tests.

PFAS in well guidance and outreach

The health department’s standard well‑testing guidance now includes PFAS. Any group that offers testing, education, or ads must include this guidance in written materials. The department may leave out a listed test if past results or strong science show it is not needed. The state provides $16,000 in FY 2026–27 for PFAS brochures. It also funds one Environmental Specialist and $106,877 in FY 2026–27 for landlord testing outreach and rules.

Home sellers must disclose PFAS tests

When you sell a home with a private well, you must disclose on the state form if water tests found PFAS or other unsatisfactory results. Buyers get clearer information about well safety before closing.
