Stronger Health Department subpoenas and privacy rules
The law lets the Health Department commissioner, a delegate, or the department’s lawyer issue subpoenas during investigations. These investigations include suspected abuse, neglect, exploitation, or credible licensing violations. A subpoena can require people or facilities to give records or information, including medical records. The department can ask the District Court to enforce a subpoena. Anyone who complies is immune from civil or criminal liability for sharing those records. Records the department gets must stay confidential under state law.
