Stronger health department subpoenas and privacy

The law lets the Maine Department of Health and Human Services issue subpoenas during investigations of suspected abuse, neglect, exploitation, or credible license violations. The health department can demand needed and relevant records, including confidential health care information. It can ask the District Court to make someone comply. Anyone who follows a subpoena is protected from civil and criminal liability for sharing records. Records the department gets by subpoena stay confidential under existing state privacy laws.
