Health records for children in state custody

If a child under 18 is in state custody, the child’s care team can get the child’s medical records. The medical director, child and adolescent psychiatric or nurse consultants, and case aides working under them may request records from the child’s providers. The department may also use the state health information exchange. They may use the information only to understand current conditions, medicines, and immediate medical needs and to keep treatment going.

Mortality review panels can access records

The maternal, fetal, and infant mortality review panel coordinator can review health records of a deceased person and of a mother whose child died within one year of birth, including fetal deaths after 28 weeks. The Aging and Disability Mortality Review Panel coordinator can review records of a deceased adult who was receiving services. Providers may share only the records needed for each panel’s review.
