Stronger benefit protections for Michigan foster children
Beginning October 1, 2026, benefits received under sections 8f and 8g belong to the Michigan child in foster care. When the health department’s responsibility ends, it must release remaining money under the funding source’s rules. Without those rules, money goes to the child at age 18 or older, or if emancipated. Otherwise, it goes to the person responsible for the child, or to the child’s heirs if the child has died. After complying with section 8f, the department must immediately notify the appointed guardian ad litem and supervising-agency contact about benefit activity. Notices cover benefit applications, applications to manage benefits, government decisions or messages, and department-requested appeals or other actions. If the department manages or receives benefits, it must also notify the child through these representatives before each permanency planning hearing. These notices must list dates and amounts received since the last notice and all assets and resources. That includes benefits, insurance, cash, trusts, earnings, and other resources. Existing court-required notices remain required. The act ties these rules taking effect to enactment of House Bill 4750.
