Animal cruelty sentences include repayment options
Effective immediately, courts can order people sentenced for animal cruelty to repay investigation, prosecution, and animal-related costs. Covered costs include seizure, care, housing, veterinary care, and the animal's transfer, adoption, or euthanasia. Courts must explain on the record why they award only some applicable costs or require only partial payment. The sentence cannot include costs the defendant already paid through the specified security deposit or bond.
Seized animals face costs and forfeiture
The law took effect immediately. Agencies generally cannot return seized animals to owners or possessors charged with animal cruelty while the case is pending. Seizing a service animal is optional. Agencies must give notice and set the required bond or security deposit within 72 hours of seizure. Owners or possessors generally have 14 days after notice to post payment covering 30 days of costs or request a hearing. Requested hearings must happen within 21 days, and courts must consider ability to pay when reviewing the amount. After an adverse ruling, owners or possessors have 72 hours to post the court-ordered amount. Additional payments cover 30-day periods while the case continues. Owners or possessors owe specified costs unless the court finds the seizure was not substantially justified by law. Missing payment deadlines or failing to attend a required hearing can lead to losing the animal. After conviction, the court awards the animal to the agency for evaluation and disposition. If the usual notice, bond, and hearing process was not used, prosecutors can seek civil forfeiture before the criminal case ends.
