Employer donor-leave credit with deduction limits

For tax years beginning on or after January 1, 2026, Michigan employers paying individual or corporate income tax get a new credit. It covers 100% of qualifying organ-donation leave wages, up to 12 weeks per employee. Employers need a written policy offering this leave beyond other paid leave, at no less than usual wages. Employees must use all other leave benefits first and provide written physician verification. Qualifying donations include organs for transplant and bone marrow donated through peripheral blood stem cell apheresis. Leave can be used before, during, or after donation. Employers claim the credit in the year leave ends; wages from the immediately preceding tax year can count. The credit cannot produce a refund, but unused amounts carry forward for up to 3 years. Owners of qualifying pass-through businesses can share the credit based on business income shares or another Treasury-approved method. Corporate taxpayers must add credited wages back to their Michigan tax base if they deducted those wages federally.
