7 provisions identified: 1 benefits, 3 costs, 3 mixed.
The director can no longer require supervised consumer credit lenders to file the specified $1,000 bond. The law also removes express charges for examiners’ actual travel expenses and a $100 daily allowance per examiner. Necessary examination costs remain chargeable when a supervised lender is examined more than once yearly, or another lender is examined.
Missouri’s director of finance can charge credit services organizations up to $1,000 to file a registration statement. The former maximum was $400. The fee must be reasonable, and the director does not have to charge the maximum.
Missouri title lenders and covered lenders making unsecured loans of $500 or less pay director-set license fees capped at $5,000. The cap is $1,000 for applicants that never exceeded 100 active accounts during the previous licensing year. Each additional location can cost up to $1,000. The small-loan category excludes banks, trust companies, credit unions, savings banks, and savings and loan companies. Annual fees go to the Consumer Licensing Fund and are due December 31 for the January 1–December 31 licensing year.
Earned wage access providers must get a Missouri license. They, supervised consumer credit lenders, and consumer legal funding companies pay director-set license fees capped at $5,000. The cap is $1,000 for applicants that never exceeded 100 active accounts during the previous licensing year. Each additional location can cost up to $1,000. Annual fees go to the Consumer Licensing Fund and are due June 30 for the July 1–June 30 licensing year.
The law creates Missouri’s Consumer Licensing Fund for money directed into it by law. The Division of Finance can use it only for administration costs not otherwise payable from three existing funds. Those are the Division of Finance, Residential Mortgage Licensing, and Division of Savings and Loan Supervision funds. Unspent balances and investment earnings stay in the new fund. This provision sets no fee amount or appropriation.
Missouri financing institutions and sales finance companies replace their former $600-per-location fee with director-set license fees. The license fee can reach $5,000, plus up to $1,000 for each additional location. The license-fee cap is $1,000 for applicants that never exceeded 100 active accounts during the previous licensing year. Annual fees are due December 31 for the January 1–December 31 licensing year. Payments go to the Consumer Licensing Fund.
Missouri premium finance companies must get licenses instead of registering, replacing the former $600 annual registration fee. Director-set license fees are capped at $5,000, plus up to $1,000 for each additional location. The license-fee cap is $1,000 for companies that never exceeded 100 active accounts during the previous licensing year. Annual fees go to the Consumer Licensing Fund and are due June 30 for the July 1–June 30 licensing year. A revised application after a material information change costs another $300.
