Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Therapy funding for eligible Missouri veterans

The law creates a fund to pay providers for prescribed hyperbaric oxygen therapy for eligible Missouri veterans. Veterans must have a PTSD or traumatic brain injury diagnosis, voluntarily agree, and previously seek Veterans Health Administration or available private insurance care. Facilities must give upfront cost estimates, including cognitive testing, and get Missouri Veterans Commission approval before treatment. Treatment requires FDA-approved equipment, licensed practitioners, a written treatment plan, and safety, privacy, clinical, and health-data standards. Payment depends on appropriations and available money; facilities cannot bill veterans for covered therapy. The commission must pay accepted bills within 45 days, up to the amount reserved for that veteran. It may reallocate reserved money when treatment is not scheduled or billed within six months. The fund also supports commission administration and alternative-therapy studies, accepts donations, earns investment income, and keeps unspent money rather than returning it to general revenue.

Access protections for veterans seeking therapy

State officials cannot block hyperbaric oxygen therapy access for veterans who meet the law's eligibility and treatment requirements. Any qualified facility can provide the therapy. Licensing boards cannot discipline practitioners solely for recommending it to veterans. State agencies also cannot act against practitioners' Medicare or Medicaid certification solely for that recommendation. Counseling and recommendations must follow medical standards; therapy can also occur under an institutional review board with a national clinical trial number.

Veterans' therapy reporting and cost recovery

Fund-paid facilities must assess veterans before and after therapy using accepted protocols and report individual and group results. Reports include veterans' demographics, numbers treated, therapy sessions, cognitive test results, and testimonials only when voluntarily provided. Before January 1 each year, the commission must report the previous fiscal year's treatments, provider types, veterans served, outcomes, and spending. The commission must seek repayment from TRICARE, federal agencies including the Veterans Health Administration, and other responsible payers. Recovery efforts must rely on treatment results shown through accepted cognitive tests, brain scans, or other assessments; veterans owe no repayment under this requirement. The law also requires commission rules but declares rules proposed or adopted after August 28, 2025, void. It makes the act and Chapter 536 nonseverable and invalidates the rulemaking grant if a rule is later held unconstitutional.
