Missouri cities and counties cannot set rent caps for privately owned residential or commercial rentals. They also cannot bar landlords from rejecting applicants because their lawful income includes housing assistance. Local rules cannot limit landlords’ customary screening methods or requests for income, credit, eviction, property-damage, or criminal-history information. Localities cannot cap security deposits or require automatic tenant rights of first refusal. Local governments retain authority over their own property and voluntary rent agreements for subsidized rentals. They can also limit rent at properties assisted with Community Development Block Grant funds.
Missouri cities and counties can keep or adopt rules against rental discrimination based solely on receiving veterans’ benefits. These rules can protect both current tenants and rental applicants. Local governments do not have to adopt them, so protection depends on local policy.
A designated broker representing a buyer or tenant as a single agent must enter into a written agency agreement. The agreement must list the licensee’s duties, responsibilities, and pay terms before covered brokerage work begins. The requirement excludes ministerial acts, such as the routine tasks defined in state law.
