Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Less state oversight of local utility rates

Beginning July 1, 2026, the Commission has less authority over rates for adequately provided city gas, water, electricity, and sewage service. This applies within city limits and up to one mile outside them. The law also limits rate oversight for some cooperative gas and electric services, certain nonprofit water and sewage services, and water districts. It does not set new rates or change bills.

State commission keeps rate dispute role

Beginning July 1, 2026, the Mississippi Public Service Commission keeps exclusive authority over many utility rate matters. It can set retail rates and hear challenges to rates, bills, and supporting information. The law also bars the Commission from regulating natural gas production, gathering, and certain sales or distribution near the gas field, as well as the internal affairs of covered entities.

Audits for struggling city-owned utilities

Beginning July 1, 2026, the Commission can hire firms for annual audits of city-owned utilities with a Department of Health rating of D or F. The mayor or a supermajority of the city council can request an audit. The utility pays the audit cost, and findings are due to the Commission and Public Utilities Staff by December 1 each year. The Commission sets civil fines for violations; the law gives no fine amount.
