Beginning July 1, 2026, charter schools can contract at or below fair market value to use buildings from school districts, colleges, and public or private groups. Public places like libraries, museums, performing arts venues, theatres, cinemas, churches, and colleges can host charter schools if zoning and land‑use rules already allow it.
Beginning July 1, 2026, every deed or lease of school property must say the property returns to the district if it stops being used for the approved purpose or for a board‑approved alternative. Buyers or tenants must keep the property in good repair and carry insurance. If they break these rules, the school board can reenter and seek legal remedies. This reversion rule does not apply when the board keeps a partial ownership interest.
Beginning July 1, 2026, charter schools in the district get the first chance to buy or lease a closed school or unused parts of a school site at or below fair market value. They have 12 months from the school board’s closure vote to make a deal; after that the right ends, except for contracts signed within that year. For the first six months after closure, the district cannot sell or lease to others unless every charter school in the district declines. If a conversion charter is approved, the district must offer that school its building at or below fair market value.
